A Sigh of Relief for Motorists

The High Court in Pretoria has today declared the Administrative Adjudication of Road Traffic Offences Act and the AARTO Amendment Act unconstitutional and invalid.

The  AARTO Act was signed into law by President Cyril Ramaphosa in 2019.

The planned demerit system for traffic offenses is based on this legislation. The demerit system was set to take away a point every time a driver is found to be in violation of traffic laws, which will see motorists losing their driver’s licenses.

The court has ordered the minister of Transport and the Road Traffic Infringement Agency to pay the legal costs of the Organisation Undoing Tax Abuse, OUTA.

A spokesperson for the organisation, Stefanie Fick, says AARTO would not have improved road safety, nor reduce road fatalities in South Africa.
