Constitutional Court Rules RICA as Unconstitutional

The Constitutional Court has confirmed that sections of the Regulation of Interception of Communications Act, known as the RICA Act are unconstitutional.

The ruling comes after investigative journalism unit Amabhungane, took the matter to court after it emerged that journalists had been the subject of state surveillance without their knowledge.

The court has found that the Act fails to provide adequate safeguards to ‘protect the right to privacy among other points.
