ActionSA leader Herman Mashaba says the fire incident in Marshalltown, central Johannesburg, is a case of culpable homicide.
The devastating fire claimed the lives of 73 people, including seven children, with more than 40 individuals sustaining injuries.
A search and recovery operation is underway as authorities say they are expecting the death toll to rise.
The incident has raised concerns about the rise of hijacked buildings in the city.
Mashaba, who is also a former mayor of Johannesburg says the fire could have been avoided.
Meanwhile, Build One South Africa has expressed sympathy for families affected by the fire. The party has commended the Emergency Services for its swift response and has mobilised its networks for donations and services.
