The African National Congress has told the Constitutional Court that the Electoral Commission must include its candidates for six municipalities if required by law.
The ANC filed an appeal to the Electoral Court after failing to meet the deadline when capturing a list of over 180 candidates for registration at the Independent Electoral Commission (IEC).
The party blamed the late submission on a technical glitch in the system, however the IEC did not accept their late submission.
Thus, the ANC stands to lose contestation of 181 candidate from over six municipalities in the Eastern Cape, KwaZulu-Natal and the Free State.
Legal representative Daniel Berger argues that failing to click the final submission button should not automatically disqualify the party’s lists.
He says changing the ballot papers would cost approximately 720-thousand-rand, and argues excluding the candidates could undermine voters’ rights.

He has argued at the Constitutional Court that the party complied with all statutory and regulatory requirements for candidate nominations before the Electoral Commission’s deadline.
