South African Olympic champion Caster Semenya has won a major legal victory at the European Court of Human Rights (ECHR), which ruled that Switzerland violated her right to a fair hearing in her battle against World Athletics’ controversial testosterone regulations.

The Grand Chamber of the ECHR found that the Swiss Federal Court failed to properly consider Semenya’s appeal after she was barred from competing unless she took hormone-suppressing medication.

The case will now return to Switzerland’s top court for a fresh review.

While the ruling does not overturn current World Athletics rules, it reopens Semenya’s path to justice and possibly a return to competition.

Semenya welcomed the outcome, calling it a step toward dignity and fairness for all women athletes with differences in sex development.
