Audio Recording In Meyiwa Trial Not Admissible

The High Court in Pretoria has ruled that a three-hour recorded alleged confession of Bongani Ntanzi in the Senzo Meyiwa murder trial is inadmissible.
Judge Ratha Mokgoatlheng ruled that the recording should not be submitted as evidence.
Mokgoatlheng said the recording is not in the interest of justice as submitting the recording would result in an unfair trial for the accused.
Ntanzi was recorded by magistrate Vivian Cronje in 2020 while she was taking down his alleged confession, however his defence argued that the recording was infringing on his rights, since he was not told that he was being recorded.

The Judge emphasised that the recording was made without the suspect’s consent, and its use would tarnish the administration of justice.
