Disgraced doctor Nandipha Magudumana’s lawyer, Anton Katz, says South African police had no business operating beyond the country’s borders.
Magudumana is challenging the legality of her arrest in the Constitutional Court after losing her appeal in the Supreme Court of Appeal earlier this year.
In 2023, Magudumana and her boyfriend, convicted murderer Thabo Bester, were repatriated from Tanzania to South Africa after fleeing the country following Bester’s dramatic escape from prison.
The pair were arrested in Tanzania after an international manhunt involving South African authorities and regional law enforcement agencies.
Magudumana is facing 38 charges, including fraud, corruption and aiding and abetting an escape. Her criminal trial is scheduled to begin in July this year.
Katz argued before the Constitutional Court that the manner in which Magudumana was returned to South Africa amounted to a subversion of international law. He contended that South African police exceeded their authority by allegedly participating in actions outside the country’s jurisdiction.
